2. Description of Service
DesignHenna provides an AI-powered henna design generation service. Users can generate unique henna designs using text prompts and download the generated images. The Service operates on a credit-based system where users purchase credits to generate designs.
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Credits and Payments
- Credits are required to generate henna designs.
- One credit is consumed per successful image generation.
- Credits do not expire and are non-transferable.
- All purchases are final. Refunds are only provided if a generation fails due to a technical error on our end.
- Prices are subject to change without notice.
5. Acceptable Use
You agree not to use the Service to:
- Generate content that is illegal, harmful, or offensive
- Infringe on any intellectual property rights
- Attempt to bypass any security measures or rate limits
- Use automated systems to access the Service without permission
- Interfere with or disrupt the Service
6. Intellectual Property
Generated Content: You retain rights to the images you generate using the Service, subject to the following:
- You may use generated images for personal and commercial purposes.
- We may display watermarked versions of generated images on our platform for promotional purposes.
- Clean (non-watermarked) downloads are only available for images you have generated with your credits.
Our Content: All other content on the Service, including the website design, logos, and software, is owned by DesignHenna and protected by intellectual property laws.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR MEET YOUR SPECIFIC REQUIREMENTS. AI GENERATED CONTENT MAY NOT ALWAYS MEET YOUR EXPECTATIONS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESIGNHENNA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF THE SERVICE.
9. Indemnification
You agree to indemnify and hold harmless DesignHenna and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
10. Termination
We reserve the right to suspend or terminate your account at any time for any reason, including violation of these Terms. Upon termination, your right to use the Service will immediately cease. Unused credits may be forfeited upon termination for cause.
11. Changes to Terms
We may modify these Terms at any time. We will notify you of significant changes by posting a notice on the Service or sending you an email. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DesignHenna operates, without regard to conflict of law principles.
